1. Introduction
Welcome to HollowTrailForge ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at hollowtrailforge.sbs (the "Service") operated by HollowTrailForge.
By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
2. Service Overview
HollowTrailForge offers exclusive yacht charter services which include:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
All services are subject to availability and appropriate weather conditions. We reserve the right to adjust or halt services at our discretion.
3. Booking and Reservations
3.1 Booking Process
For charter reservation, the following is required:
- Minimum age of 18 years
- Submission of valid and complete information
- Advance payment as indicated in the booking confirmation
- Acceptance of these Terms & Conditions
3.2 Confirmation
Confirmation of your reservation happens when payment is received and we provide written acknowledgment. We have the authority to deny service to any person at our sole discretion.
3.3 Availability
Charter services rely on the availability of vessels and favorable weather conditions. We will make reasonable efforts to fulfill your preferred scheduling requests.
4. Payment Terms
4.1 Pricing
All quoted prices are in € and are inclusive of applicable taxes unless otherwise specified. Price quotes are subject to change without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the total cost of the charter at the time of reservation
- Final Payment: Required 48 hours before the scheduled departure of the charter
- Extra fees (if applicable): To be cleared upon charter completion
4.3 Payment Methods
Accepted forms of payment include major credit cards, bank transfers, and certified cheques. All transactions are processed through secure and encrypted methods.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Over 72 hours prior to departure: Full refund minus processing costs
- 24-72 hours before departure: Refund of 50% of the total cost
- Less than 24 hours prior to departure: No refund is provided
5.2 Weather Cancellations
Should the weather conditions be unsafe as determined by the captain, options include:
- Rebooking the charter for another available date at no extra charge
- A full refund if rebooking isn't feasible
5.3 Mechanical Issues
If there are mechanical issues with the assigned yacht, efforts will be made to arrange an alternative. In cases where this isn't possible, a complete refund will be issued.
6. Safety and Conduct
6.1 Safety Requirements
All guests must comply with the following:
- Adhere to instructions from all crew members
- Utilize safety equipment as necessary
- Declare any health conditions that may affect their safety
- Stay within designated yacht areas
6.2 Prohibited Items
Items not allowed on board include:
- Glass materials
- Unlawful substances
- Weapons of any sort
- Excess amounts of non-alcoholic drinks
- Pets, unless pre-arranged
6.3 Conduct
Passengers must show respect and behave orderly. We retain the right to end a charter prematurely without a return of payment if the conduct of any passenger is unsafe or disrupts others.
7. Liability and Insurance
7.1 Our Liability
We limit our responsibility to the amount paid for the charter. We are not accountable for:
- Personal harm resulting from the negligence of passengers
- Theft or harm to personal belongings
- Indirect, special, or punitive damages
- Delays caused by weather or other circumstances outside of our control
7.2 Insurance Coverage
Our operations and vessels are covered by comprehensive marine insurance. Charter guests are advised to have their own travel and personal insurance in place.
7.3 Assumption of Risk
By opting for our charter services, you acknowledge the intrinsic risks associated with maritime activities and accept personal accountability for your safety and welfare.
8. Modifications and Itinerary Changes
We reserve the right to alter itineraries, course of travel, or timetables based on meteorological conditions, safety prerequisites, or operational needs. We will endeavor to offer alternatives of comparable quality.
9. Force Majeure
Events out of our reasonable control such as, but not limited to, will not result in liability on our part:
- Harsh weather conditions
- Natural calamities
- Regulatory stipulations
- Port closures
- Vessel malfunctions
10. Privacy and Data Protection
Your private data will be managed according to our Privacy Policy. By employing our services, you agree to the collection and use of your information as outlined in our Privacy Policy.
11. Intellectual Property
All content on our website, like text, imagery, signs, and pictures, falls under copyright and trademark legislations. You may not reproduce, circulate, or produce derivative works without explicit written consent from us.
12. Governing Law
The effective laws within Monaco will apply to these Terms. All disagreements will be settled in courts situated in Monte Carlo, Monaco.
13. Changes to Terms
We maintain the right to adjust these Terms whenever necessary. Any modifications will be noted on our site with an accompanying revision date. Your continued usage of our services demonstrates conformity to the changed terms.
